Building Defense Narratives That Actually Persuade

Open almost any news source and you’ll see it: massive monetary awards to plaintiffs. The era of the nuclear verdict has arrived, and there’s no sign it’s slowing down. There are many reasons for this shift. 

 

But one factor stands out: Plaintiff attorneys have mastered narrative. Defense teams, by and large, have not.

 

Plaintiff lawyers increasingly build aggressive, story-driven cases that move juries and mediators to act. Defense arguments, meanwhile, often rely on something that used to be enough: a logical presentation of the facts.

 

Today, that’s no longer sufficient.

Logic Alone Doesn’t Win

Take medical malpractice as an example. Proving the standard of care may establish the facts, but facts alone rarely move people. Jurors and mediators are human. And humans make decisions through a combination of reason and emotion

 

When a defense argument focuses solely on technical explanations or a linear march through medical science, the real story of the case often gets lost.

 

To win today, defense counsel must do more than prove the facts. They must make us feel the nuances of the case.

For decades, I’ve perfected these principles with graduate students at the Northwestern University to Fortune 50 CEOs around the globe, always crafting narratives that move people to act.
